Data protection and data sharing
As part of the competition, participants’ personal data will be processed as follows:
Responsible person

Purpose, legal basis, data categories and storage period
To carry out the competition, the organizer processes the first and last name and email address of the participants in accordance with Art. 6 Para. 1 lit b GDPR (“fulfillment of the contract”).
The organizer stores the data mentioned until the competition has been completed. In addition, the organizer only stores this data to the extent that this is necessary to fulfill legal retention obligations or to the extent that this is necessary to assert, exercise or defend legal claims.
Recipient
The above-mentioned data of the winners will be transmitted to the cooperation partners below so that the prizes won as part of this competition can be redeemed. The transmission of the winners’ data to the cooperation partners is necessary for the redemption of the prizes – and thus for the fulfillment of the contract (Article 6 Paragraph 1 lit b GDPR).
The above-mentioned data of those participants who did not win as part of the competition will only be transmitted if the participants have given their express consent (Article 6 Paragraph 1 lit a GDPR). Such consent is given by participants ticking the relevant box at the end of the competition form. This consent is not required to participate in the competition, so participants can take part in the competition even without granting this consent. Consent given can be revoked at any time without giving reasons with future effect to Österreich Werbung.

This privacy policy informs you about the processing of your personal data by the registered association “Austrian National Tourist Office” as the controller under the GDPR, with registered office at Vordere Zollamtsstraße 13, 1030 Vienna, phone: +43 1 58 866-0, fax: +43 1 58 866-20, e-mail. anfrage@austria.info (“ÖW” or “we”) in connection with photo and video recordings at the pop-up stands of Austrian National Tourist Office at the locations (i) Neuss, Oberhausen (Germany), (ii) Utrecht (Netherlands), (iii) Copenhagen (Denmark), (iv) Warsaw (Poland) and (v) Vienna (Austria).
1. PURPOSE AND LEGAL BASIS OF DATA PROCESSING
1.1 The Austrian National Tourist Office creates photo and video recordings at its own pop-up stands at the locations (i) Neuss, Oberhausen (Germany), (ii) Utrecht (Netherlands), (iii) Copenhagen (Denmark), (iv) Warsaw (Poland) and (v) Vienna (Austria) to document and report on the events and publishes these on its own social media channels:

1.3 For the purpose of documenting/reporting and publishing these photo and video recordings, Austrian National Tourist Office processes the following personal data about you:
1.3.1 Photo/video recording on which you can be seen
1.3.2 Place and date of the photo/video recording
1.4 The legal basis for this data processing is the legitimate interests of Austrian National Tourist Office and its above-mentioned partners pursuant to Art. 6 para. 1 lit. f GDPR, which consist of documenting the events organized by the Austrian National Tourist Office as a commercial enterprise and reporting on them publicly.
1.5 The areas in which photo and video recordings are made by Austrian National Tourist Office are marked by clearly visible signs at the respective event locations.
1.6 The provision of the above-mentioned data for publication on the social media channels and on the website is not required by law or contract or for visiting the respective pop-up stand. You can object to this data processing at any time by contacting the Austrian National Tourist Office using the contact details given at the beginning or by directly contacting the respective ÖW employee on site (Art. 21 GDPR).
1.7 Notwithstanding the above, the Austrian National Tourist Office attaches great importance to the protection of your privacy and selects the recordings that are published with great care, so that recordings that could lead to the risk of discrediting or discriminating against a person depicted or that show minors and particularly vulnerable persons are deleted immediately. Likewise, recordings in which individual persons are particularly in focus (e.g. in an interview) are only published if separate consent (which can be revoked at any time) has been given.
2. STORAGE PERIOD
2.1 The Austrian National Tourist Office stores the above-mentioned personal data for as long as is necessary to achieve the purpose. Once the purpose has been achieved, ÖW will always delete your personal data.
2.2 In addition, the Austrian National Tourist Office will store your personal data for longer if this is necessary to pursue or defend against legal claims or to fulfill statutory retention obligations.
3. DATA RECIPIENTS
3.1 Processors. We use processors (e.g. for sending postal advertising) who process data on our behalf. The processors may only process the data provided to them in accordance with our instructions and to perform services for us. We contractually oblige these processors to guarantee the confidentiality and security of the personal data processed within the scope of the order.
3.2 Data transfer to third countries. We may transfer personal data to recipients in countries outside the EEA. The level of data protection in other countries outside the EEA may not be the same as within the EEA. However, we only transfer your personal data to recipients in countries for which the European Commission has decided that they have an adequate level of data protection. If this is not the case, we take measures to ensure that all recipients in third countries guarantee an adequate level of data protection. For example, we conclude the standard contractual clauses issued by the European Commission with these recipients. 4. RIGHTS
You have the following rights vis-à-vis the Austrian National Tourist Office as the controller under the GDPR: (i) access (Art. 15 GDPR); (ii) rectification (Art. 16 GDPR); (iii) erasure (Art. 17 GDPR); (iv) restriction of processing (Art. 18 GDPR); (v) objection (Art. 21 GDPR); (vi) data portability (Art. 20 GDPR); (vii) complaint to the competent supervisory authority (Art. 77 GDPR), whereby in Austria the data protection authority (www.dsb.gv.at) is responsible.
